Periodic Tenancy Explained
What happens when your fixed term ends, your rights on a rolling contract, and notice periods.
A periodic tenancy is a rolling contract that continues on a week-by-week or month-by-month basis. It offers flexibility but different notice rules apply.
Types of Periodic Tenancy
- Statutory periodic - created automatically when a fixed term ends
- Contractual periodic - a rolling tenancy from the start
- Weekly or monthly depends on how often you pay rent
Notice Periods
To end a periodic tenancy:
- Tenant: usually one rental period (typically one month)
- Landlord (Section 21): two months
- Landlord (Section 8): varies by ground used
- Notice must end on the correct day
From May 2026, ALL tenancies will become periodic under the Renters' Rights Act. Fixed terms will no longer exist.
